Customer - the User who placed the Order in the www.eveesther.com online store

Online store - an Internet site owned by an Individual Entrepreneur ( Bratanova Anna Evgenievna ), located on the Internet at www.eveesther.com, where the Goods offered by the Vendor for purchase are presented, as well as the terms of payment and delivery of the Goods to the Customers. In addition, www.eveesther.com website is an Internet showcase designed to demonstrate the range of goods available to the Customer for the purpose of sale.

Date of payment - is considered a day (depending on the selected method of payment for the Goods):
• of final transfer of funds to the Vendor’s settlement account 
• cash receipt by courier 

Services - delivery services for purchased Goods, Customer consultation when choosing the Goods and other similar services provided by the Vendor, the types and cost of which are brought to the attention of the Customer when purchasing Goods on the Site.

Agreement - a public contract of sale, concluded by accepting its terms by the Customer in accordance with the rules below.

Goods - clothing, accessories and other goods offered for sale on the Site.

Order - a duly executed Customer request of for the purchase and delivery to the address specified by the Customer / by customer pick-up of the Goods selected on the Site. Only Goods marked as "in stock" can be subject of purchase and sale.

1.1. The Vendor sells Goods through www.eveesther.com online store 
1.2. When ordering Goods at the Online Store, the User agrees to the terms of sale set below (hereinafter referred to as the Terms of Sale of Goods). In case of disagreement with these rules, the User is obliged to immediately stop using the service and leave the Site.
1.3. These sale of goods Rules, as well as information about the Goods presented on the Site, are considered as public offer in accordance with Article 435 and Clause 2 of Article 437 of the Civil Code of the Russian Federation.
1.4. These Rules may be changed by the Vendor unilaterally without prior notice to the User/Customer. The new version of the Rules comes into force after 10 (Ten) calendar days from the date of its publication on the Site.
1.5. The public offer is recognized as accepted by the Customer from the moment the Visitor registers on the Site, the Customer places an Order without authorization on the Site, and also from the moment the Customer accepts the Order by phone: +7 (926) 2167781
1.6. The retail sale and purchase agreement is considered as concluded from the moment the Vendor issues a cash or sales receipt or another document confirming payment for the goods to the Customer. 
1.7. By providing the Vendor with his full name, e-mail and phone number, the Customer agrees to the use of these means of communication by the Vendor, as well as third parties involved for the purpose of fulfilling obligations to the Customers, in order to carry out mailings of an advertising and informational nature containing information about discounts, upcoming and current promotions and other Vendor events, about the transfer of the order for delivery, as well as other information directly related to the fulfillment of obligations by the Customer under these Rules.
1.8. By placing an Order, the Customer agrees that the Vendor may entrust the execution of the Agreement to a third party, while remaining responsible for its execution.
1.9. All rights and obligations under the Agreement concluded with the User arise directly from the Vendor.
1.10. As part of the Order, the Individual Entrepreneur Bratanova A.E. provides the User with information support of the Agreement concluded between the User and the Vendor.
1.11. An order in the online store can be placed 24 hours a day, 7 days a week, except for periods of routine maintenance or technical failures.
1.12. Return of goods is carried out remotely. Information on how to make a return is available on the Site in the "Return" section. Jewelry and custom-made items are non-refundable.

2.1. The subject of the public contract of sale are the Goods presented in the online store catalogue.
2.2. The Sale Rules apply to all types of Goods presented on the Site, as long as such offers with a description appear in the online store catalogue.
2.3. The Customer places the Order by himself in any way available on the Site, choosing from among the possible methods of payment and delivery of the Goods.
2.4. The Customer pays for the selected Goods and Services the 100% amount in accordance with the prices valid at the time of of the Order placement. The price (cost) of the Goods is set by the Vendor and can be changed by him at any time.
2.5. The Vendor delivers the Goods to the Customer in the manner and within the time limits determined in accordance with the procedure established by this Agreement. Also, the Customer can carry out self pick-up of the Goods.
2.6. The order is considered to be completed after its 100% payment by the Customer and the transfer of the Goods to the Customer. The fact of the transfer of the Goods is confirmed by the Customer's signature on the document provided by the Courier or personally by Individual Entrepreneur Bratanova A.E. upon self pick-up of the Goods by the Customer.
2.7. By placing an Order on the Site, the Customer agrees to receive emails containing information about the services and offers provided by the Vendor. If unwilling to receive e-mails, the Customer must send an e-mail to info@eveesther.com or turn off the notification option in his personal account on the site.
2.8. The date of the Agreement is the date of the Order been placed by the Customer on the Site.

3.1. Registration on the Site is carried out in the shopping cart section when purchasing goods
3.2.  Registration on the Site is not mandatory for placing an Order.
3.3.  The Vendor is not responsible for the accuracy and correctness of the information provided by the User during registration.
3.4.  Communication between User/Customer with managers and other Vendor representatives should be based on generally accepted morality and communication etiquette principles. It is strictly forbidden to use obscene words, swearing, offensive expressions, as well as threats and blackmail, regardless of the form and to whom they were addressed.
3.5.  If the User, the Customer in the opinion of the Vendor, behaved incorrectly when communicating with managers and / or committed intentional actions against company employees (causing harm to health, hooliganism, insults, threats, restriction of freedom, etc.), the Vendor reserves the right to unilaterally cancel  User’s / Customer’s  Order.  These provisions are not a manifestation of discrimination and are not aimed to infringe the rights guaranteed by the legislation of the Russian Federation to consumers, but are aimed to reduce the losses of the Site from Customer unfair actions.

4.1. In the absence of the Goods ordered by the Customer in the warehouse of the Vendor, the latter has the right to exclude the specified Goods from the Order / cancel the Customer's Order by notifying the Customer via an appropriate electronic message to the address specified by the Customer during registration.
4.2. The Customer is fully responsible for the provision of incorrect information, which entailed the impossibility of the Vendor to properly fulfill its obligations to the Customer.
4.3.  After placing an Order on the Site, the Customer is informed about the expected delivery date by sending an electronic message to the address specified by the Customer during registration, or by phone.  The manager serving this Order specifies the details of the Order, confirms the address and delivery date, which depends on the availability of the ordered Goods in the Vendor's warehouse and the time required for  Order processing and delivery.
4.4.  The expected delivery date of the Goods is announced to the Customer by the manager servicing the Order via e-mail or a follow-up call to the Customer.

5.1. Methods, as well as approximate delivery times for the Goods presented on the Site, are indicated on the Site in the "Delivery and Payment" section;
5.2. Delivery area for Goods presented on the Site is limited by the territory ofvRussian Federation/ 
5.3.  Upon delivery, the Order is handed over to the Customer or a third party specified in the Order as a recipient (hereinafter the Customer and the third party are referred to as the "Recipient").  If the Order paid in cash cannot be received by the above persons, the Order may be handed over to a person who can provide Order information (tracking number and / or full name of the Recipient), as well as pay the cost of the Order in full to the person delivering the Order.
5.4.  In order to avoid cases of fraud, as well as to fulfill the obligations assumed under paragraph 5 of these Rules, upon delivery of the prepaid Order, the person delivering the Order has the right to request an identity document of the Recipient, as well as indicate the type and number of the document provided by the Recipient on Order receipt. The Vendor guarantees the confidentiality and protection of the Recipient's personal data (clause 9.3.)
5.5.  The risk of accidental loss or accidental damage to the Goods passes to the Customer from the moment the Order is transferred to him and the Recipient of the Order confirms  the delivery by signing the documents. In case of non-delivery of the Order, the Vendor shall reimburse the Customer for the cost of the  prepaid Order and delivery in full after receiving confirmation of the loss of the Order from the Delivery Service.
5.6.  The Vendor's obligation to transfer the Goods to the Customer is considered fulfilled at the time the Goods are delivered to the Recipient or received by the Recipient at the post office or at a predetermined pickup location (including pickup point).
5.7.  Upon receipt of the Order at the post office, the Recipient, after paying for the delivered Goods, has the right to inspect the delivered Goods and open it in the presence of Post employees to check the Goods for compliance with the declared quantity, assortment and completeness of the Goods, as well as check the expiration date of the delivered Goods and the packaging safety. In the event of claims to the delivered Goods (incompletement, insertion of the Goods other than the item indicated in the inventory, manufacturing defects, other claims), the Recipient initiates  Post employees to draw up a Statement of Identified Inconsistencies.
5.8.  In the event of the return of the Goods delivered by Post due to claims, the Recipient is obliged to attach the following documents to the Shipment of returned Goods: an application for a refund; a copy of the act of identified non-compliances; a copy of the payment receipt; a copy of the inventory of the shipment; return form.
5.9.  When accepting the Order from the courier, the Recipient has the right to inspect the delivered Goods and check for compliance with the declared quantity, assortment and completeness of the Goods, as well as check the expiration date of the delivered Goods and the packaging safety. If there are no claims to the delivered Goods, the Recipient shall sign the Order Delivery Form or other similar document provided by the courier and pay for the Order (if not 100% pre-payed). By signing the delivery documents the Recipient confirms that there are no claims to the Goods and the Vendor has fully and properly fulfilled its obligation to transfer the Goods.
5.10.  Сourier delivery procedure to the Recipient’s address is limited to 15 minutes
5.11.  The Vendor guarantees the proper quality of the Goods offered to the Customers.

6.1. The price of the Goods is indicated in  Russian rubles.
6.2.  The price of the Goods on the Site can be changed by the Vendor unilaterally. In this case, the price of the Goods already ordered by the Customer is not subject to change. The price of the Goods may vary by region. 
6.3. When paying for the Goods using bank cards:

• In accordance with regulation of  Central Bank of Russian Federation "On the issue of bank cards and on operations performed using payment cards" dated December 24, 2004 No. 266-P, bank card transactions are performed by the cardholder or a person authorized by him.
• Bank card transactions are authorized by the bank. If the bank has reason to suspect the operation is fraudulent, the bank has the right to refuse to carry out this operation. Fraudulent transactions with bank cards are subject to Article 159 of the Criminal Code of the Russian Federation.
• In order to avoid cases of various kinds of illegal use of bank cards when paying, all Orders placed on the Site and prepaid with a bank card are checked by the Vendor.
• The Vendor has the right to provide discounts on Goods and establish a loyalty program. The types of discounts, bonuses, the procedure and conditions for accrual are determined by the Vendor’s independently and are indicated on the Site and can be changed by the Vendor unilaterally.

6.4. Upon delivery of Goods by Post, the total cost of goods is subject to an increase according to delivery amount specified in the Delivery Section. And upon delivery….?

7.1. The Customer has the right to refuse the ordered Goods at any time before receiving it, and  within 14 days after receiving the Goods, not counting the day of purchase, with an exception for Goods that are not subject to return in accordance with regulatory legal acts of Russian Federation. Return of the Goods of good quality is possible if its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the specified Goods are preserved.
Returns are not possible for custom-made products with an individual abbreviation.
7.2.  If the Customer refuses the Goods in accordance with clause 7.2.1. The Vendor refunds the cost of the returned Goods, except for the Vendor's expenses related to the delivery of the Goods returned by the Customer, within 10 days from the date the Vendor receives the returned Goods back at warehouse, together with the return application completed by the Customer.
7.3.  If at the time of the Customer's application, a similar product is not available on sale, the Customer has the right to demand a refund of the amount paid for the specified Goods. The Vendor is obliged to return the amount paid for the returned goods within 10 days from the date of return of the Goods.
7.4. A product of inadequate quality means a product that is defective and cannot ensure the performance of its functional qualities. The received Goods must correspond to the description on the Site.
7.5 Appearance and completeness of the Goods, as well as the completeness of the entire Order can be checked by the Recipient at the time of delivery of the Goods.
7.6.  Upon delivery of the Goods, the Customer signs the delivery receipt in the field: “The order was accepted, the completeness is full, I have no complaints about the quantity and appearance of the goods”, or in another similar document issued by the Vendor, in the field where the Customer marks he has no claims to the completeness and quantity of the Goods.
7.7.  If the Customer received the Goods of inadequate quality and this was not agreed in advance by the Vendor, the Customer has the right to use the provisions of Art. 18 "Consumer rights in case of defects in the product" of the Law on the Protection of Consumer Rights.
7.8.  Claims for the refunds for paid goods must be satisfied within 10 days from the date of the relevant requirement (Article 22 of the Law of the Russian Federation "On Protection of Consumer Rights").
7.9.  Refunds are made by transfer of the cost of paid Goods to a bank card or by postal order. The method must be indicated in the appropriate field of the return application form, which can be drawn up in any form, but with the obligatory indication of the exact passport data of the User / Customer and bank details.

8.1.  The Vendor is not liable for damage caused to the Customer due to improper use of the Goods.
8.2. The Vendor is not responsible for the content and operation of external sites that link to this Site.

9.1.  User/Customer’s personal data is processed in accordance with the rules of the Federal Law "On Personal Data" No. 152-FZ.
9.2.  When registering on the Site, the User provides the following information: Last name, First name, Middle name, contact phone number, email address, and the selected goods.
9.3.  By providing personal data to the Vendor, the Site Visitor / User / Customer agrees to its processing by the Vendor, including the purpose of fulfilling the Vendor's obligations to the Site Visitor / User / Customer under these Rules, promoting goods and services by the Vendor, conducting electronic and sms surveys, monitoring the results of marketing campaigns, customer support, organizing the delivery of goods to Customers, holding giveaways among Site Visitors / Users / Customers, monitoring the satisfaction of the Site Visitor / User / Customer, as well as the quality of services provided by the Vendor.
9.4.  Processing personal data means any action (operation) or a set of actions (operations) with personal data performed with or without the use of automation tools, including collection, recording, systematization, accumulation, storage, clarification (updating, changing) extraction, use, transfer (including transfer to third parties, not excluding cross-border transfer, if the needed for obligations fulfill), depersonalization, blocking, deletion, destruction of personal data.
9.5. Vendor has the right to send information, including advertising messages, to  User/Customer’s e-mail and mobile phone with his consent, expressed by performing actions that unambiguously identify this subscriber and allow him to reliably establish his will to receive the message. The User/Customer has the right to unsubscribe from advertising and other information without explaining the reasons by informing the Vendor of his refusal by sending an appropriate application to the Vendor's email address.
9.6.  Vendor has the right to use "cookies" technology. Cookies do not contain confidential information. The Visitor / User / Customer, in accordance with these rules, agrees to the collection, analysis and use of cookies, also by third parties, for the purposes of generating statistics and optimizing advertising messages.
9.7.  Vendor receives Site visitor’s  ip-address information. This information is not used to identify the visitor.
9.8.  Vendor has the right to record telephone conversations with the User/Customer. At the same time, the Vendor undertakes: to prevent attempts of unauthorized access to information received during telephone conversations, and / or its transfer to third parties not directly related to the execution of Orders, in accordance with paragraph 4 of Art. 16 of the Federal Law "On Information, Information Technologies and Data Protection".

10.1. Vendor has the right to assign or transfer his rights and obligations arising from relationship with the Customer to third parties.
10.2. Online store and the  provided services may be temporarily partially or completely unavailable due to preventive or other work or for any other technical reasons. The Vendor’s technical support has the right to periodically carry out necessary preventive or other work with or without prior notice to the Customers.
10.3.  In case of questions and claims from the User/Customer, he has the right to contact the Vendor by phone or in any other available way.
